Indeed. It is also how things like IDW’s comics exist, because they legally approach Hasbro, come to an agreement, and a license is given. Folks like G.M. Berrow write their books, with permission, and occasionally even end up writing for the show itself.
 
Fan works, like Jan Animation’s stuff, fall under a gray area. They’re not legal. But they’re generally so numerous and don’t actually represent competition for someone like Hasbro (though, plushie makers kinda do), that Hasbro can’t reasonably go after everyone. There’s also a big enough sense of entitlement among fan content creators and their fans (as seen here for Jan) that there will likely always be some amount of backlash. So they have to prioritize and decide if it is really harmful to Hasbro and/or worth pursuing to enforce their rights.
 
Of course, some copyright owners can generously give permission to others to use their stuff. That too is in their rights. But that certainly doesn’t change the rights of owners who don’t choose to do the same.

Except it wasn’t too far at all. It was the correct thing to do.
 
I get that some people have this bizarre notion that Hasbro is an evil corporation, despite giving us things like ponies and transformers and G.I. Joe that many people love and grew up with. More than just MLP:FiM. The notion is that Hasbro doing anything remotely “negative” is seen as bad because they’re an evil corporation, full stop.
 
Put into a less “evil corporation perspective though. Lets say you invent something. You get a great idea. It’s yours. You think about the idea, refine it, and eventually you decide to make it. Maybe a friend or family member says, “hey, that’s a great idea. Can I buy one? I like it so much that I want to pay you for one of my own.” Maybe, because they’re a friend/family, you give them one for free. You’re a nice guy, after all. But somewhere along the line, you get the idea of, “hey. I can sell this, people will want it and be willing to pay for it.” So you do so. You gather some money, borrow, take a loan, whatever it takes. You get what you need to make more, and lo and behold, you’re successful. You sell this thing you invented. People like it. It’s popular.
 
Now, some random folks decide to copy your idea. Because it is popular. They sell their copies. They might be able to get away with it, but in order to have any chance at all of them not getting away with it, you’d take them to court. If they’re indeed doing an illegal copy, then hopefully the evidence proves it and the court will help you out to protect your product and ensure you get to sell your produce and earn profit from it, not some random other people just copying you.
 
Yes, things get complicated when you add in licensing, fair use, fan-works, and so on. But, by and large, copyright is a right of the creator/owner of a thing. Hasbro, regardless of your opinion of them, has a right to the things they own. You have to have permission to use their thing.
 
Jan did not have that permission. Most of the artists with work uploaded on this site do not have permission. Hasbro has the right to not want any of this to happen with their thing they own. A Cease and Desist letter is a courtesy. It is simply a letter from one person to another, with no legal weight or consequence to it. It is the owner of a thing, Hasbro, telling another person, Jan, “hey. I noticed you’re using my thing. I didn’t say you could, stop.”
 
Obviously, Jan could ignore that, and continue making his videos. But then Hasbro could take him to court, and likely would win. Because Hasbro is protecting its rights and Jan was in the wrong.

Until there’s an alternative way to access free content while simultaneously making it difficult for underaged persons to access said material, that shall be the way it goes. The internet is at times too unrestricted, as proponents of SOPA, et cetera have expressed over the decades (albeit in culmination with their horrible discretion ideas, lel.)

You’re not wrong about the likeness part — back in my early days, I thought Jan’s “Picture Perfect Pony” was part of an episode that I missed, and it took me almost a full year to realized that it was fan-made. So, I can understand why Hasbro decided to take action. Although, a C&D is a bit too far and rubbed most of us in a bad way.

Which is why projects incorporating another art style altogether manage to survive oversight such as Banned and tiarawhy, but projects such as Fighting and Jan’s animations do not because their likeness in the official art style can create implicit situations between Hasbro, their child demographics, and the proverbial fan artist middlemen who can create unintentional episodes between the two with their unofficial and more adult content of varying degrees. ^_^;
