IDK what you’re saying anymore, my entire argument is “crimes should be judged on their specifics, and emotional circumstance shouldn’t be ignored”.

I’ll admit you can’t force people to do meditation or whatever, but that doesn’t make it a good thing.
Just because these problems exist doesn’t mean they should get preferential treatment over those who were only a danger to one or two people rather than everyone around them.

This is not an RPG, what is that? Classically a berserker is a person armed with heavy weapons such as battle axes and war hammers, and usually has either heavy or no armor. Its not like beserkers cant maintain there cool, although soldiers (especially after duty) might be jumpy.
That said. Different things can trigger different behaviors, you can people to not lose their cool under most situations but sometimes it happens. Its human nature, how are you gonna fight it?
People are responsible for managing those lapses of judgement, are they not? I’d feel more comfortable next to an assassin than a berserker.
That`s why having a system where only the outcome of a crime is considered is unjust. Everyone has lapses of judgement whether it be a overcome by emotions or just didn’t think something through, but our current justice system doesn’t care about the events that transpired, it only looks at the actual crime.
I’ve always considered crimes of passion to be a shameful thing. They’re always a loss of control, a failure to stick to the plan, a derail. Not like, you know, a bank job or a murder-for-hire. Those are business.
Depends on the situation, sure generally hitting, and hurting people is bad, but our emotions are often uncontrollable and punishment should fit the specifics of a crime.
For example: The spouse who comes home and their other is cheating on them, in a fit of rage/ emotions, they commit a double homicide. Is it bad to kill people? Under most conditions, yes, but i think the killer should at worst be given a lighter sentence and at best just years of pre-paid therapy.
Can we at least agree that spousal abuse not generally being seen as acceptable any more is a good thing?

Yeah, but it used to be even worse. At least divorce has generally become more acceptable nowadays, which means less people would have to resort to murder or suicide in order to escape a marriage gone horribly wrong.
Marriage early on was more of a family contract, so it was the trade of genetics within families. At that point in time, i would be ok/support it. But now its garbage.

Marriage could theoretically serve a useful, or at least pleasant, purpose, but the institution’s been abused and misused in various ways pretty much since day one.
That said, good luck getting rid of anything even tangentaly related to religion. The church has its claws sunk too deep.
